End User License Agreement

Gold Standard Group ("GSG," "we," "our," or "us") grants you a limited, non-exclusive, non-transferable, revocable license to install and use Ani-Me on Apple devices that you own or control, subject to this EULA and the Apple App Store Terms of Service. This license does not include any right to sublicense, sell, redistribute, or commercially exploit the application.

This license is granted solely for your personal, non-commercial use unless you have entered into a separate written commercial use agreement with GSG.

You must be at least 13 years of age to use Ani-Me. If you are between 13 and 18 years of age, you represent that a parent or legal guardian has reviewed and agreed to this EULA on your behalf. By using Ani-Me, you represent and warrant that you meet these eligibility requirements.

You may not use Ani-Me if you are located in a country subject to a U.S. government embargo, or if you have been designated as a Specially Designated National or placed on any U.S. government prohibited or restricted party list.

GSG reserves the right to verify eligibility and to terminate access if eligibility requirements are not met.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify GSG immediately of any unauthorized use of your account. GSG is not liable for any loss or damage arising from your failure to protect your account credentials.

You may not create more than one account per person. Duplicate accounts may be terminated without notice. You may not create accounts on behalf of others without their express written consent.

You retain ownership of the photos you upload and any videos generated through your use of Ani-Me ("User Content"). You grant GSG a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, process, transmit, reproduce, and modify your User Content solely as necessary to provide and improve the Ani-Me service.

This license terminates when you delete your content or your account, except where we are required to retain copies for legal, safety, or operational reasons. You are solely responsible for making backups of your content. GSG does not guarantee content preservation.

Any feedback, suggestions, or ideas you provide about Ani-Me become the property of GSG without any compensation or obligation to you.

Ani-Me uses machine learning models to generate video content from your inputs ("AI-Generated Content"). You understand and accept the following:

• AI-Generated Content is produced algorithmically and results may be unpredictable, inconsistent, or unexpected.
• Similar or identical outputs may be generated for other users submitting similar inputs.
• AI-Generated Content may unintentionally resemble copyrighted works, real persons, real locations, or existing media.
• GSG does not warrant that AI-Generated Content is original, free from third-party claims, or suitable for any particular purpose.
• GSG does not warrant that AI-Generated Content will be accepted by any third-party platform, publisher, or content distributor.
• AI model quality, style, and capabilities may change over time as we update underlying models.

You assume full responsibility for reviewing, evaluating, and deciding whether to publish or distribute any AI-Generated Content. GSG is not liable for any claim arising from the content you generate or distribute.

Before uploading any photo or other content to Ani-Me, you represent and warrant that you have all necessary rights, permissions, and consents to do so, including:

• Ownership of, or a valid license to, any photo you upload.
• Written consent from every identifiable individual depicted in any photo you upload, including consent to animate, transform, or alter their likeness using AI.
• All applicable rights relating to names, faces, voices, and likenesses, including publicity rights, under the laws of the relevant jurisdiction.
• The right to grant GSG the license described in Section 4.

You may not upload photos of identifiable real persons — including public figures, celebrities, athletes, influencers, or private individuals — without their explicit, informed, and documented consent to have their likeness animated and distributed. Consent from a third party on behalf of another person is not sufficient unless you are a legal guardian acting on behalf of a minor.

You may not use Ani-Me to generate, distribute, or promote:

• Sexually explicit content of any kind, including non-consensual intimate imagery or simulated sexual acts.
• Any sexual, suggestive, or exploitative content involving minors.
• Defamatory, harassing, or threatening content targeting any real individual.
• Deepfakes or synthetic media designed to deceive, impersonate, or misrepresent a real person.
• Content designed to incite violence, hatred, or discrimination based on protected characteristics.
• False or misleading election-related content, voter suppression material, or political disinformation.
• Fraud, identity theft, phishing, or impersonation of any individual or organization.
• Fake endorsements or misleading commercial testimonials using real persons' likenesses.
• Content that violates any applicable local, state, national, or international law or regulation.

Violations may result in immediate account suspension or termination, forfeiture of unused credits, and may be referred to law enforcement where required or appropriate.

GSG reserves the right, but not the obligation, to review, screen, monitor, remove, or refuse to process any User Content or AI-Generated Content at any time, with or without notice, for any reason or no reason, including suspected violations of this EULA or applicable law.

GSG may suspend or terminate your account, refuse generation requests, remove shared content, and block abusive or repeat-offending users at its sole discretion. GSG is not liable for any content it fails to detect, remove, or moderate.

Ani-Me requires credits to generate videos. Credits are available through monthly subscription plans or one-time credit packs, purchased exclusively through the Apple App Store.

• Credit consumption: Credits are consumed when a generation request is submitted, not when the output is delivered. Credits are consumed even if a generation fails, produces unexpected results, or is not to your satisfaction.
• Subscription credits: Reset at the start of each billing period and do not carry over. Unused subscription credits expire at the end of the billing period.
• Credit pack credits: Do not expire under normal circumstances but may be subject to account-level expiration on termination.
• Refunds: Credits are non-refundable except where required by applicable law. Subscription fees are non-refundable after the billing period begins.
• Free tier: Free accounts receive a limited number of credits and are restricted to standard quality output without AI audio. Quality and credit limits for free accounts may change at any time.
• Abuse: GSG reserves the right to limit, suspend, or revoke credits on accounts suspected of fraudulent activity or abuse of the credit system.

All billing and subscription management is handled by Apple. To cancel a subscription, go to your iPhone Settings → Apple ID → Subscriptions. GSG does not process refund requests directly for App Store purchases; such requests must be submitted to Apple.

Ani-Me, including all underlying technology, software, algorithms, models, design, branding, and proprietary methodologies, is the exclusive property of GSG and its licensors. Nothing in this EULA transfers any ownership or intellectual property rights to you.

All rights not expressly granted in this EULA are reserved by GSG.

GSG respects intellectual property rights and expects users to do the same. If you believe that content accessible through Ani-Me infringes your copyright, please contact us at thegoldstandardgrp@gmail.com with the subject line "DMCA Notice" and provide the following:

• A description of the copyrighted work you claim has been infringed.
• A description of where the infringing material appears within the application.
• Your contact information, including name, address, phone number, and email.
• A statement that you have a good faith belief that the use is not authorized by the copyright owner.
• A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.
• Your electronic or physical signature.

GSG maintains a policy of terminating the accounts of users who are repeat copyright infringers in appropriate circumstances, as determined by GSG in its sole discretion.

Ani-Me relies on third-party AI model providers, cloud infrastructure services, and content delivery networks to operate. By using Ani-Me, you acknowledge and agree that:

• Your content may be transmitted to and processed by third-party AI model providers as part of the generation process.
• Service availability depends in part on the availability of third-party providers outside GSG's control.
• GSG is not liable for outages, errors, or data handling by third-party providers.
• Third-party providers may have their own terms of service and acceptable use policies that apply to your content.

Ani-Me may contain links to third-party websites or services. GSG is not responsible for the content, privacy practices, or terms of any third-party service.

Your use of Ani-Me is governed by our Privacy Policy, incorporated by reference. By using Ani-Me, you consent to the collection and use of information as described in the Privacy Policy.

Uploaded photos and generated videos may be retained for a limited period to enable video delivery, support, and safety review, then deleted according to our data retention schedule. You should maintain your own backups of any content you wish to keep. GSG does not guarantee indefinite storage of your content.

Ani-Me is provided on an "as available" basis. GSG does not guarantee uninterrupted access to the application or any specific response time for video generation. GSG may:

• Modify, suspend, or discontinue any feature or the entire service at any time.
• Perform scheduled or unscheduled maintenance that temporarily interrupts service.
• Change or discontinue AI models, generation styles, or quality tiers.
• Impose usage limits, rate limits, or queue times during periods of high demand.

GSG is not liable for any loss or damage resulting from service unavailability, generation delays, or feature changes.

ANI-ME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. GSG expressly disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. GSG does not warrant that Ani-Me will be error-free, uninterrupted, secure, or that any defects will be corrected. AI-generated outputs are not guaranteed to be unique, free of third-party rights, or suitable for any specific purpose.

You agree to defend, indemnify, and hold harmless GSG and its officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising from or relating to:

• Your use or misuse of Ani-Me.
• Content you upload, generate, publish, or distribute using Ani-Me.
• Your violation of this EULA, applicable law, or any third-party rights, including intellectual property rights, privacy rights, and publicity rights.
• Any claim that your content caused damage to a third party.

To the fullest extent permitted by applicable law, GSG shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, data, goodwill, or other intangible losses, arising from or relating to your use of or inability to use Ani-Me.

GSG's total cumulative liability to you for any claims arising from or relating to this EULA or Ani-Me shall not exceed the greater of (a) the total amount you paid to GSG in the twelve months immediately preceding the event giving rise to the claim, or (b) twenty-five U.S. dollars ($25).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, GSG's liability is limited to the maximum extent permitted by law.

Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy arising from or relating to this EULA or your use of Ani-Me that cannot be resolved informally shall be resolved exclusively by binding arbitration administered by a nationally recognized arbitration organization under its then-current rules, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.

Class Action Waiver: You and GSG each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

Before initiating arbitration, both parties agree to first attempt to resolve the dispute informally by contacting GSG at thegoldstandardgrp@gmail.com. If the dispute cannot be resolved within 30 days, either party may commence arbitration.

This EULA is governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles. For any claim not subject to arbitration under Section 18, you consent to the exclusive jurisdiction of the state and federal courts located in Wyoming.

This EULA is between you and GSG only, not with Apple Inc. Apple is not responsible for Ani-Me or its content. Apple has no obligation whatsoever to provide maintenance, support, warranty, or product liability services for Ani-Me.

GSG, not Apple, is solely responsible for addressing any claims you or any third party may have relating to Ani-Me or your possession and use of Ani-Me, including: (i) product liability claims; (ii) any claim that Ani-Me fails to conform to any applicable legal or regulatory requirement; (iii) claims arising under consumer protection or similar legislation; and (iv) intellectual property infringement claims.

You represent and warrant that (i) you are not located in a country that is subject to a U.S. government embargo or that has been designated as a "terrorist supporting" country, and (ii) you are not listed on any U.S. government list of prohibited or restricted parties.

Apple Inc. is a third-party beneficiary to this EULA and, upon your acceptance, Apple will have the right to enforce this EULA against you.

GSG may update this EULA at any time. Material changes will be communicated through the application or by email. Continued use of Ani-Me after changes take effect constitutes your acceptance of the updated EULA. If you do not agree to the updated terms, you must stop using Ani-Me.

If any provision of this EULA is held invalid or unenforceable, the remaining provisions continue in full force and effect. The failure of GSG to enforce any right or provision of this EULA will not be deemed a waiver of such right or provision. This EULA constitutes the entire agreement between you and GSG concerning Ani-Me and supersedes all prior agreements.
